Zognition Terms of Use for ZogniQ Doctor Portal
Welcome to Zognition Doctor Portal. Please read these Terms and Conditions carefully before using our website or purchasing any of our products. By accessing or using our site, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our site.
1. Scope of Services
The Platform provides registered medical professionals (“Users”) with access to the ZogniQ ZPL™ low-level laser light therapy (LLLT) device and supporting AI-driven patient analysis tools. Features include: controlled application of wellness light treatments, secure storage and management of patient records and 8K images, AI-assisted analysis through HIPAA-compliant servers, and the ZogniQ.com Doctor Login Portal for record review and management.
2. Authorized Use
Access is limited to licensed healthcare professionals and authorized staff. Users must comply with local medical regulations and ensure proper device operation. The ZogniQ ZPL™ device is for therapeutic and diagnostic purposes only and is not a substitute for independent medical judgment.
3. Patient Data Privacy and Security
Zognition stores, transmits and processes all PHI (Protected Health Information) on our HIPAA compliant systems, hosted in the United States, ensuring Confidentiality, Integrity and availability of PHI. For Confidentiality and Integrity control of the data stored and in transit, we use strong cryptographic systems such as AES 128, TLS 1.3, SHA 256, WPA3. In addition, our systems are regularly assessed by external experts, to ensure the top-level security of our systems, processes and patient’s data. To ensure patient data privacy we use de-personalization techniques aligned with the HIPAA Privacy Rule and GDPR.
Secure transmission is ensured through Zognition-provided WPA3 Enterprise networking hardware designed to maintain HIPAA-compliant encrypted communications between the ZogniQ ZPL™ device and Zognition backend infrastructure.
4. AI Analysis and Clinical Responsibility
AI analysis results are advisory and intended to assist healthcare professionals. Zognition does not provide diagnoses or treatment recommendations. Clinical decisions remain solely with the licensed practitioner.
5. Data Ownership and Access
Users retain ownership of patient records. By using the Platform, Users grant Zognition a limited license to store, process, and analyze data for operational and AI-model improvement. Users may request export or deletion of patient data by contacting support@zognition.com.
6. Device and Software Updates
Devices and software may receive automatic firmware or AI model updates. Users agree to maintain systems with the most recent updates provided by Zognition.
7. Limitation of Liability
Zognition and its affiliates disclaim all warranties, express or implied. Zognition shall not be liable for indirect or consequential damages arising from use of the device or Platform. Total aggregate liability shall not exceed the amount paid by the User in the twelve (12) months preceding the claim.
8. Compliance and Audit
Users must comply with all applicable HIPAA, FDA, and medical device regulations. Zognition may audit account usage for compliance and data integrity. Unauthorized modification or reverse engineering is prohibited.
9. Termination
Zognition may suspend or terminate access for violation of these Terms or applicable law. Upon termination, patient record retention and lawful data handling obligations remain in effect.
10. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Disputes shall be resolved exclusively in Michigan state or federal courts.
